Who Can Apply For Naturalization?

Not all immigrants in the U.S. are eligible for naturalization. You may be able to pursue this route if you:

  • Have held a green card for at least five years
  • Are married to a U.S. citizen and have had permanent resident status for at least three years
  • Are a permanent resident who has served in the U.S. military for at least a year or in a time of hostility

The process of becoming a naturalized citizen of the United States involves several steps such as:

  • The naturalization application: You start the process by filing Form N-400 along with the required fee.
  • The biometrics appointment: You may be asked to attend an appointment during which certain biometrics (such as fingerprints) are collected to verify your identity.
  • The interview: This interview will be with a United States Citizenship and Immigration Services (USCIS) officer. It generally includes civics and English tests.
  • The decision: The USCIS determines whether or not to approve your application for citizenship.
  • The naturalization ceremony: Once you receive approval from the USCIS, you’ll need to attend such a ceremony to officially become a citizen. During it, you will take the Oath of Allegiance and receive your naturalization certificate.

What Tests Are Required To Become A Citizen?

Most applicants will take two tests during their USCIS interview:

  • The civics test: In which you’ll be given questions on U.S. history and government

Generally, you need to pass both of these citizenship tests in order to have your application approved. If you fail a test, you can retake it in a second interview. This generally happens within 60 to 90 days. If you fail a second time, you’ll receive an application denial. We can guide you in preparing for these critical tests.

What If Your Application For Naturalization Is Denied?

You can appeal such a denial by filing Form N-336. You need to do this within 30 days of the denial. A hearing will then occur in which a USCIS officer will determine whether to uphold or reverse the denial. If the denial is upheld, you can restart the application process using Form N-200 after you address the underlying issues, as there is no limit to the number of times you can apply for naturalization.
